Following vocal objection by residents, the concept of automatic fines for violations of the rules and regulations for certain offenses was modifed to require a first and only notice for certain egregious repeat violations. This subset is summarized as approved by the Board in June of 2023.

In the event of a violation, then, the offender is given the usual warning. Subsequent occurrences of the same violation are subject to a fine without further warning, regardless of the time elapsed between violations. The appeals process still applies for any fine.

A homeowner may choose to put up hurricane shutters in early May…

because they are leaving for parts unknown. The prior situation would result in a warning letter to fix the violation within 30 days or be fined. The homeowner could choose to just ignore the letter, because the shutters would automatically be in conformance with the regulations by June 1, before the fine was applied. The next year, the situation would occur again, still resulting in no fine.

A homeowner may choose to park their vehicle on the wrong side of the street…

for whatever reason they choose to break a traffic law. A warning letter is issued, the homeowner moves the vehicle, and no fine is applied. Next month, the homeowner does it again. Another warning, another vehicle movement, and no fine. Continue this scenario as often as you like.

In summary, the homeowner is essentially ignoring the regulations. With this change, a fine would be automatic on the second (and the third, and the fourth, …) occurrence.

    • News Weather etc. directly access popular categories of mostly‑external sites.
